Your parental rights receive protection under the Equal Protection Clause because parental rights are individual rights, NOT rights created by marriage. Where marriage did NOT create the rights, divorce can NOT destroy the rights. Likewise, divorce between parents can NOT justify depriving the child of individually protected rights.
